Montenegrin Supreme Court Delays Extradition of Do Kwon to South Korea Amid Legal Review

The Montenegrin Supreme Court has delayed the extradition of Do Kwon, the co-founder of Terraform Labs, to South Korea following a legal challenge by the Supreme State Prosecutor’s Office (VDT). According to a report by Vijesti, the delay comes after the VDT filed a request for the protection of legality, seeking to postpone the execution of decisions made by both the High Court in Podgorica and the Court of Appeal of Montenegro.

The Prosecutor’s Office is reviewing whether the conditions for Do Kwon’s extradition to South Korea were legally satisfied. The Supreme Court has decided to temporarily halt the extradition process until a decision is reached on the legality request.

The VDT’s intervention occurred just one day after the Court of Appeal upheld the High Court in Podgorica’s ruling that approved Kwon’s extradition to South Korea. This latest ruling effectively prevents the Police Directorate and the Ministry of Justice from immediately proceeding with the extradition.

The Court announced that Kwon’s extradition will remain on hold until a final decision is made on the Request for the Protection of Legality. The court’s decision on this matter is expected within the legal deadline.

Goran Radić, Do Kwon’s defense attorney, criticized the postponement, arguing that a final decision in favor of his client should not be subject to revision unless there is an abuse of judicial authority. Radić further suggested that delaying the execution of the final decision serves no legal purpose, but acknowledged that the Supreme Court could still review the issue as part of its regular judicial procedures.

This development follows Montenegro’s ruling to extradite Kwon to South Korea, rejecting an appeal to send him to the United States, where he also faces charges related to the collapse of Terraform Labs. The ongoing legal proceedings have now introduced a new layer of complexity to Kwon’s extradition case, as the Montenegrin legal system continues to evaluate the legitimacy of the extradition process.
